Item A forma de indicação e nomeação de ministros para o Supremo Tribunal Federal: estudo comparado em busca de um modelo ideal(Centro Universitário do Estado do Pará, 2021) Souza Júnior, Cristhian Karlo Quintela de; Costa, Lucas Garcia Campos; Bastos, Elísio Augusto Velloso; http://lattes.cnpq.br/9156547826965478The objective of this academic research is to analyze the current model of appointment and nominations of Ministers of the Brazilian Supreme Federal Court, given that, over the years, right and left parties end up nominating people to safeguard their own interests or beliefs, which it can end up colliding with legal certainty, with impartiality and, especially, with the satisfaction of the public interest and with republican ideals. Presidential nominations have proven to be merely subjective and not very technical. Through a comparative study that uses as reference other models of Supreme Courts and Constitutional Courts and a doctrinal and historical analysis of the current model, it is concluded that there is a need to change to an ideal model by PEC - Proposed Amendment to the Constitution -, which safeguards a coherent and technical composition of the STF and the participation of other powers in the choices of Ministers.Item Direitos indígenas em julgamento: judicialização no supremo tribunal federal e suas implicações na tutela dos direitos indígenas no período pós-constituinte de 1988(Centro Universitário do Estado do Pará, 2024) Matos, Giulia Fernandes Dias; Mendes, Sérgio Fiuza de Mello; http://lattes.cnpq.br/8831943449726262This work focuses on an analysis of the position of the brazilian Supreme Court, as an integral force of Three Powers, which constitute the Federative Republic of Brazil, and, similarly, as the maximum representative of the Judiciary in the Brazilian legal system, in the face of the protection of the rights of indigenous people, still governed under the aspect of state domain established by the Statue of the Indigenous (1973), through the investigation of its performance through the concentrated control of constitutionality on the matter in cases brought to trial bthe Court. From this perspective, the research intends to present whether the court’s position is in accordance with the ethnopolitics of indigenous people, in this sense, bringing the country closer to being classified as plurinationalist, or reaffirms and endorses the posture of a ‘guarding’ State of this group, elucidating, for this, the process of internal consolidation, contextualizing with the historical scenario.Item STF e opinião pública: como o populismo judicial estruturou decisões da Corte no curso da operação Lava Jato(Centro Universitário do Estado do Pará, 2022) Rocha, Gustavo Sousa Pantoja da; Mendes Filho, Sérgio Fiuza de Mello; ttp://lattes.cnpq.br/8831943449726262The presente paper conducts a study on the development of judicial populismo and the problems involving its manifestation in the Supreme Federal Court, in the period of the “Lava Jato” operation. For this, it develops a broad historical survey on the emergence of constitutional courts to the establish an analysis of the role of the Supreme Court in Brazilian constitutional jurisdiction. Then, it discusses the concepts of political and judicial populism to, finally, verify its manifestations in court decisions.
