Item A cooperação federativa nas políticas públicas de educação básica: análise das políticas de financiamento, propostas do governo federal e dos educadores(Centro Universitário do Estado do Pará, 2016-01-27) Palácios , Fernando Rocha; Cichovski, Patricia Kristiana Blagitz; http://lattes.cnpq.br/8940927801366003; Brito Filho, José Cláudio Monteiro de; http://lattes.cnpq.br/2244189950353544; Rocha, Francisco Sérgio Silva; http://lattes.cnpq.br/7008329184256326This work has as main objective to analyze the characteristics of federal cooperation in the implementation of educational policies, focusing on the financing of basic education, the proposals of the current Federal Government (Secretariat of Strategic Affairs and Ministry of Education) and the Educators' Forum (CONAE). Comprising an interdisciplinary approach (law, political science and education) intended to carry out a legal analysis of the phenomenon focus. The field of study outlined the theme covers various aspects of federalism. However, this will focus on cooperative federalism and sub-themes more directly related to it: its principles and basic characteristics; the study of coordination, collaboration and cooperation; decentralization and centralization and skills of the ones down in the Constitution. Methodologically it is based on a dialectical view of the law, being developed a historical and procedural approach of educational policies in the Brazilian federalism in order to understand the origins and dynamics of legal changes that were constituting forms of relationship between the federal agencies in the area educational. To obtain the data was made a documentary and bibliographic research and interpretation of these was used discourse analysis method. The analysis of legislation and related documents may be concluded that intergovernmental cooperation in the Brazilian federalism, specifically in education policy, although present in all the principles that underlie the rules and proposals, presents quite different features that bring significant implications to the Brazilian federalism and the Federal Constitution.Item Federalismo cooperativo e política nacional de educação: mito ou realidade?(Centro Universitário do Estado do Pará, 2019) Campos, Nelma Lima e Silva; Simões, Sandro Alex de Souza; http://lattes.cnpq.br/2124140489726435; Dantas, Elza Ezilda Valente; http://lattes.cnpq.br/3951303999926297; Bastos, Elísio Augusto Velloso; http://lattes.cnpq.br/9156547826965478This dissertation has its construction based on scientific research, and intends to answer the following question: do the national curricular bases reveal themselves as a demonstration of a problem of the Brazilian federative asymmetry? Its guiding principle is the following hypothesis: yes, the national curricular bases reveal the progressive tendency of the Brazilian State to centralize public policies, as, for example, in the area of Education, as a response to the problem of federative asymmetry. Its main objective is to understand if the Brazilian State's way of dealing with asymmetry has been to progressively centralize government responses, as well as public policies in the area of Education. As specific objectives, it is proposed to: 1) analyze the relationship between educational policy and the Brazilian federal state; and 2) identify whether cooperative federalism is still preserved in the Brazilian Federal State. To unveil the object of research, it was necessary to provide theoretical support from authors who investigate federalism, public and educational policy and basic education, among which the following stand out: Baracho (1995), Bercovici (2004), Horta (2010), Ramos (2013a, 2013b), Oliveira, R. (2010), Abicalil (2013), Dourado (2010, 2013), Saviani (2014, 2005) and Stefano (2015). It adopts the paradigm of qualitative research, and as instrument for data collection, bibliographic research. This study confirms the hypothesis that guides it, considering that the Union has been moving towards centralism, thus delimiting the field of action of state governments and municipalities. In this sense, it has adopted some mechanisms that confirm this conduct, mainly with regard to the adoption of budgetary containment policies. In analyzing the results, the study concludes that the Union has not developed its actions based on federal cooperation, since, instead of promoting the participation of other entities in the management of problems and contributing to the strengthening of those who do not have adequate conditions to face those problems, that, although local, are in the same federative space, it has presented solutions unilaterally. The research seeks to understand how the Union has been dealing with the problem of asymmetry, and observes a persistent policy of standardized treatment that is extended to all federated entities, although they are not the same. This policy has been manifested, mainly, by the centralism of the Union, where federated entities are not compelled to adapt to national guidelines that, increasingly, limit their roles and their competences. It is in this sense that we can say that cooperative federalism has been secondary. And despite the questioning presented in the title of this dissertation, it is possible to conclude that, in the way that this relationship between cooperative federalism and national education policy has been established, it has been shown to be increasingly distant from “reality” and closer to the "Myth".Item Gestão multiescalar em áreas de preservação ambiental costeiras: o caso da APA Algodoal-Maiandeua(Centro Universitário do Estado do Pará, 2023) Pinheiro, Giuliana dos Santos; Tupiassú, Lise Vieira da Costa; http://lattes.cnpq.br/5599627735526045; Fischer, Luly Rodrigues da Cunha; http://lattes.cnpq.br/5038078976448551; Fonseca, Luciana Costa da; http://lattes.cnpq.br/3383269305393137The present work analyzes the structuring of management, in multiple federative and territorial scales, focusing on coastal conservation units, through a brief study of the APA Algodoal- Maiandeua, located in the municipality of Maracanã, State of Pará, northern Brazil, answering to the issue of how the management of coastal conservation units is delineated at multiple federative and territorial scales. The research was developed using the deductive method and the bibliographic technique, based on specialized references to address the profusion of legal instruments applicable to the Brazilian Coastal Zone, the multiscale management exercised in the APA Algodoal-Maiandeua, and the socio-environmental problems faced in the area. From the research carried out, it was found that the sustainable development of the APA Algodoal- Maiandeua can occur from the effective and clear division of competences on the part of the public organizations and entities involved in its management, passing to exercise them in an integrated way. Moreover, in view of the constitutional distribution of the political-administrative competences of the federative entities, it is of paramount importance, both for the realization of the political and financial autonomy of these entities, and for the realization of fundamental rights, that they exercise their tax competences, developing the effort tax needed to improve the quality of life of the population and its economic development.Item Mobilidade urbana e federalismo: repartição de competências em matéria de transporte público coletivo no município de Belém(Centro Universitário do Estado do Pará, 2015) Rendeiro , Carla Blanco; Cichovski, Patrícia Kristiana Blagitz; http://lattes.cnpq.br/8940927801366003The present work aimed to analyze the distribution of competences between the entities of Brazilian federation arranged in the Federal constitution of 1988 in particular, the urban competences related to urban mobility and urban public transport, in order to demonstrate how the issue affects the joint actions of governmental entities in Belem township. The actions aimed the execution of mobility in the cities, especially those aimed at motivating the use of collective public transport, are understood as public functions. In the exercise of these functions, the governmental entities should identify their respective competences to legislate about the issue and implement the necessary actions for development observing the constitutional and infra-constitutional principles and rules. Thus, it was identified, first , the origin of the term urban mobility and its current concept, by inserting it in the context of urbanization and metropolization of the country, showing that the current definition widespread in Brazil from actions of the Federal government in 2003, is not restricted to the legal concept and it is inserted in a bigger context that requires the participation of the public power to ensure that the movement of people and goods occur efficiently , safely, physically accessible , financially and sustainable in order to provide the social function of the city and, therefore, a better quality of life for people. It was also done, an analysis of Federalism and about the formation of the Federal Brazilian state to identify the general situation of the distribution of competences in matter of urbanistic and in urban transport and, from this analysis , reach the diagnosis of the performance of municipal, state and federal governments in Belem township , while head of the metropolitan region in actions aimed at improving the urban and metropolitan transports , implementing the constitutional order to exercise their common and competitive competences in a coordinated and cooperative way.
