    Aborto como política de saúde pública a partir das diretrizes internacionais da ONU e da legislação uruguaia

    The following paper intends to demonstrate abortion as a matter of public health and family planning, as well as an instrument capable of reducing maternal mortality caused by unsafe abortions and accomplishing gender equality as stipulated by the article 5th of the Federal Constitution. For this purpose, examines the decisions taken on the cases of K.L v. Peru and T.P.F. v. Peru – both from committees aligned to the United Nations –, the legal provisions of the International Covenant on Economic, Social and Cultural Rights about sexual and reproductive health and the General Recommendation n. 35 about gender-based violence from the Committee on the Elimination of Discrimination Against Women (CEDAW). Beyond that, the paper will approach the social and cultural context that has taken Uruguay to considerably reduce its maternal mortality rates caused by unsafe abortions, through the development of a risk and harm reduction program prior to decriminalization, and the quantitative and qualitative analysis of data collected after the country decriminalized abortion. Finally, the matter is approached on national level, through the analysis of both Brazilian legislation and academic studies related to the subject in the current prohibitionist context.

    This article studies the Inter-American System of Human Rights Protection, especially regarding the right to migration and refuge in the decisions of the Inter-American Court. Bibliographical research is carried out in national and international articles and reports from organizations and agencies that deal with human rights issues. The inductive method is used in the research, since it starts from the migration cases of the Inter-American Court to understand if Brazil, a component country of the regional system, follows the recommendations. The importance of studying migration issues and forced displacement in this regional system lies in the fact that, given the increase in human mobility in recent years, especially forced displacement, it is necessary to deepen the study of this social change in the American continent and especially in the Brazilian context, to understand the advances and challenges that involve the issue of human rights and migration.

    Parâmetros de responsabilização estabelecidos pelo SIDH frente às violações dos direitos humanos no caso do rompimento da barragem de Fundão, em Minas Gerais

    The failure that occurred in the Fundão Dam, Minas Gerais, was a calamity associated with the mineral business of which Brazil has never experienced before. It stands as one of the greatest examples of Human Rights violations in the country, made worse by the State’s leniency. This research approaches to apply the IACHR’s understanding on the concrete case. Using REDESCA’s 2019 inform as basis for the thesis, as well as factual and academic research, it was concluded that both the State of Brazil as well as the businesses involved in the tragedy directly disrespected the inter american understanding regarding the duty of both parties to assure and protect Human Rights, before and after the dam’s failure.
