    The present dissertation proposes to analyze the current position of the Regional Labor Court of the 8th Region (TRT/8) in relation to indemnities for off-balance sheet damages resulting from work accidents. Thus, the objective is to investigate the theoretical and factual elements that are being used to obtain the indemnity quantum attributed in these reparatory actions, especially after the judgment by the Plenary of the Civil Unconstitutionality Claim no 216. unconstitutionality of items I to IV, of §1, of art. 223-G, CLT. Methodologically, it is an empirical-analytical, descriptive and exploratory approach, in which the conclusions will be extracted from the information that will be evidenced when analyzing the jurisprudence of the TRT/8, in order to reach the objective that motivated the present research. In order to achieve the objective of the present work, it is necessary to structure it in four parts. First, a delimitation and contextualization of the work accident in Brazil will be carried out; later, worker protection as a constitutional right will be addressed, an opportunity in which the multidisciplinary impacts of the work accident will be discussed, both on the worker's life and on life in society; afterwards, the jurisprudential understanding of the TRT/8 will be investigated, with the delimitation after the incident of the Claim of Unconstitutionality; and, finally, present the final considerations of the research.

    The present research has as general objective to analyze the correlation between work environment and decent work, in order to overcome limiting definitions and to demonstrate that the separation of concepts is not feasible. Specifically, we seek to investigate how restrictive concepts of the environment and decent work make it impossible to guarantee decent working conditions; to define which are the minimum indispensable conditions, with a view to the precaution / prevention principles, which must be present in the work environment, for the configuration of decent work, so that its concepts are expanded; and, also, to verify how the quality of the work environment affects the expansion of human capacities. The research problem consists of investigating how environmental working conditions are capable of interfering in the configuration of decent work and, consequently, in the dignity of the worker for the development of his personal aptitudes. In order to fulfill the task, the methodology that analyzes the legal treatment of the work environment will be used, as well as the framework of the work carried out under conditions that preserve human dignity. The main theoretical references, in the philosophical plane, are the teachings of Imannuel Kant, Amartya Sen, John Rawls and Ronald Dworkin and, in the legal plane, the studies of José Claudio Monteiro de Brito, Júlio César de Sá da Rocha, Raimundo Simão de Melo and Ney Maranhão. The research to be developed is substantially dogmatic, doctrinal and legislative, because although it will not be neglected from the historical and sociological reasons, pertaining to the way in which the service provision of workers is carried out and the respective impacts, the main objectives are to identify in the legal, normative and doctrinal plans the treatment given to the work environment and decent work, in order to influence the lives of workers.

    This study aims to present the need for greater action by Labour Inspection in Brazil and the need for its strengthening to ensure decent work. It is an analysis based on the Sustainable Development Goals (SDGs) of the United Nations (UN), especially SDG 8, which promotes decent work and economic growth; and the case of the employees of the Santo Antônio de Jesus fireworks factory and their families vs. Brazil of the Inter-American Court of Human Rights, which discusses degrading working conditions and slave-like conditions, justifying the violation of decent work. For the elaboration of this article, a bibliographical research was used based on several authors who deal with the subject in order to build a theoretical referential that presents as theme the Decent Work in Brazil, as well as, to seek a new critical and flexible look in order to provide answers that guide workers, to know which are the fundamental rights of the worker guaranteed and instituted by the Federal Constitution of 1988, Labor Law and International Norms of Work Protection.
