    This paper aims to analyze how the control and monitoring instruments of mining dams in the State of Pará provide information and participation for effective prevention of social and environmental damage. Thus, the general objective of the work is to contribute to the affirmation of the control and monitoring instruments of mining dams, aiming at the prevention of social and environmental damage in the State of Pará. The research involves three specific objectives. The first was to verify how information and participation can be considered as instruments of prevention of social and environmental damage in the risk society and in the Democratic State. To develop this analysis the research investigates the legal content of the principle of information, participation and prevention, essential for the exercise of participatory democracy in the risk society. The second objective was to analyze the legal system of control and monitoring of mining dams in Brazil and how they are defined in environmental licensing. The third objective was to analyze the control and monitoring mechanisms of mining dams in the state of Pará, identifying each one of them and how the control and monitoring instruments of mining dams in the state of Pará provide information and participation for effective prevention of social and environmental damage. The methodology used is applied, and to meet the proposed objectives is a qualitative and descriptive research, based on bibliographic and documentary sources, whose main challenge was the collection of data on quantity, characteristics and application of instruments of mining dams in the State of Pará. It was concluded that the principles of participation and information are necessary tools in the prevention of social and environmental damage and contribute to an effective system of control and monitoring of mining dams, it also lays the foundation for participatory democracy. The social relevance of the theme to the State of Pará is notorious, as the second state of the federation with the largest number of mining dams in its territory, for being a producer of various ores.

    This article aims to address the impact of consumer consent on the processing of personal data, based on the General Data Protection Law - Law No. 13.709/2018, analyzed through consumer relations and the principle of the company's social function. The issue to be analyzed refers to the relevance of the principle of balance in consumer relations, given the duty to realize the fundamental rights and guarantees of the consumer, simultaneously with economic, social and technological development in the country, in order to comply with the premise of the function the company's social. Thus, initially, consent is presented as a fundamental right of the consumer, as the first authorizing hypothesis for the processing of personal data. Afterwards, the need to apply the principle of the consumer's right to information is demonstrated, about equity and harmony in consumer relations in the interface of the processing of personal data provided by that law, in view of the significance of economic and social development and technological by the enactment of that law and the Consumer Code. Finally, the objective is to demonstrate the relevance of the principle of the company's social function for the occurrence of a balance between business activity and consumer rights, aiming to reconcile the highlighted principle with collective well-being and social legal protection, from of profitable production in business societies or entrepreneurs.

    This dissertation proposes a study on the impact of misleading publicity on identity consumption decisions, highlighting an interdisciplinary approach that includes legal, philosophical, sociological, advertising and even neurological aspects, based on the inputs raised by neuromarketing. The investigation presents the influence of advertising, through the articulation between the mass cultural industry, the globalization phenomenon and the internet, on consumer choices. In this context, some corporations, under the pretext of using the doctrine of corporate social responsibility, which links ethics, morality, trust, among other values, to business practices, use such precepts as mere mechanisms to attract certain consumer niches, mainly those who defend environmental causes, social rights and the socioeconomic inclusion of the excluded. However, when advertising does not match the activities of the business chain, greenwashing, bluewashing and pinkwashing are configured, respectively. Thus, the attempt to manipulate recipients by means of misleading publicity materializes in an evident fraud to identity consumption, in addition to being misleading advertising that drives the aggravation of consumer vulnerability. Thus, there is a need to deepen consumer protection in the face of advertising, which is not limited to individual law, but transindividual, with repercussions for the entire community, as well as the study of responsibility in the areas of administrative, civil and criminal. Access to information, as a basic consumer right, permeates the entire debate, as frenzied consumption, wrapped in misleading publicity, must be fought through consumer awareness and access to justice, which are intertwined with the spread of information clear, detailed and adequate. The research is exploratory and reflective, carried out by the deductive method, supported by a bibliographical survey in the national and international scope.

    O Cadastro Ambiental Rural (CAR) como instrumento de informação e monitoramento da reserva legal no estado do Pará

    The right to an ecologically balanced environment has as a plaintiff the community and also to the Government, in which both must promote their protection through public policy and environmental awareness, that would be exercised through the free access to environmental information that would ensure participation popular in state decision-making processes. In this sense, this research sought to contribute towards the defense of the access to the right to an environmental information through the Rural Environmental Registry (RER) and the Legal Reserve in the context of the current Forest Code scenario in the State of Pará, with analysis of the legal relation between these and information systems, to attend the right to environmental information. For this, was held bibliographic research about the construction of environmental information as a principle and located in the Brazilian legislative scenario. Analyzed the new treatment of the legal reserve by the current Forest Code and its representation in the State of Pará and was evidenced the discussion about the legal exemption of its registration in the Register of Deeds when performing the RER. Has been found that the legal reserve is the subject of two environmental information systems, as RER and the Register of Deeds, where both have environmental feature and can live together harmonically to fulfill the right to environmental information. It was also discussed that there are two information systems that composed the RER, the Rural Environmental Registry System - RERS, nationwide, and the Integrated System of Environmental Monitoring and Licensing - SEML, use at Pará, where it's observed that the RERS is a closed system for the access to environmental information by society, not allowing the query without restrictions, unlike SEML, which meet with the necessity of environmental regulations at the State of Pará and also the free exercise of the right to access to environmental information and, consequently, the right to an ecologically balanced environment.

    This research addresses the phenomenon of mass disinformation under social, technological and legal aspects. The process of formation and influence of (and in) public policies is presented, as well as the Brazilian internet governance. The national normative structure is managed to explain applications and uselessness of certain legal instruments existing in the battle against misinformation. The research is carried out based on bibliographic analysis, with the application of qualitative techniques, with the analysis of speeches, ideas, studies, articles, and other bibliographic materials. The hypothesis lies in the possibility of limiting the reache of opinions and thoughts on the network, as a way of balancing freedom of speach and the right to information. Solutions are presented in the form of an efficient action model to combat fake news.

    Cattle ranching began in the Brazilian state of Pará in the context of a policy, favored by military regimes, of occupation of the Brazilian Amazon that was widespread into the 1980s. Beginning in the 1990s, faced with environmental problems linked to production chains and health crises tied to food production, a new business cycle arose that was marked by the search for environmentally and socially appropriate actions and by assurances of quality and proper sourcing of products. In this context, the application of ESG agenda to ranching, in addition to mitigating production process risks and aiding conformity with sustainability standards, could bring greater awareness to beef production. A central factor in this process consists of implementing transparency in the production chain, carrying out animal tracking, in order to ensure the legality of production. In 2002 in Brazil, a system of cattle tracing was started which, nevertheless, is mandatory only for animals destined for export. For the internal market, there is still a need to improve tracking systems in order for consumers to truly have complete, reliable information about the provenance of the beef they consume. Certification is one of the mechanisms that can serve this purpose and provide consumers with information about the production process. Distinguishing labels make it possible to certify both the quality and origin of products, giving value to producers and ensuring food safety. In light of this, the study proposes to analyze how distinguishing labels can be used as a mechanism to combat the lack of traceability in the beef production chain in Pará and violations of consumers’ right to information. The specific objectives are to present the history of the beef production chain in Brazil, especially in the case of the state of Pará, characterizing the current and future structure of the chain via application of ESG principles; to understand the use of distinguishing labels for agricultural products and their relation with traceability in the beef production chain; and, lastly, to demonstrate how a consumer’s right to information contributes to food safety. This study will use deductive reasoning, with bibliographic research and access to secondary data. It is hoped that this survey will contribute to a rise in the quality of beef in the state of Pará.
