Item O direito como agente normalizador dos direitos humanos LGBTI(Centro Universitário do Estado do Pará, 2018-12-19) Souza, Ana Carolina Rodrigues de; Azevedo, Thiago Augusto Galeão de; Galeão, CamylaThis paper seeks to analyze if the Law is a guarantee instrument of rights or just a normalizing discourse ruled by a logic of domination of bodies LGBTI. Initially, it sought to analyze briefly the concepts of sexuality, sex and gender, from the theoretical reference of Michel Foucault, in order to demonstrate that such concepts are results of a social construction. Through the explanation of the Queer Theory, it seeks the deconstruction of innate and stable concepts arising from a discourse endowed with heteronormativity, focusing on the individual who escapes the heterosexual binarism. Thus, it is sustained the sexuality as a construction, in the form of a device responsible for the creation of an idea of biological sex, as well as the production of multiple sexualities, which had to be named and cataloged for controling purposes. In a second moment, it investigates the relationship between Law, Power and the Truth incident on the sex, in order to verify if the Law is a normalizable surface by the alluded power and truth and, therefore, normalizing. For that, it approaches the Law from the identification of a normalized-normalizing image crossed by the power and the constructed truth about the sex. The third moment, it establishes, with all the above, how the Law presentes itself as a normalizing tool in the creation, implementation and expansion of public policies, such as the Social Name ID, and specific spaces such as the "Third Bathroom", aiming to encompass the individuals who escape the binary and heterosexual logic imposed by the sexuality device. By the end, this work has joined one of the images of the Law, which Foucault called as the "new Law".Item Intervenção humanitária unilateral ou crime de agressão? uma análise da intervenção americana no conflito sírio(Centro Universitário do Estado do Pará, 2018) Proença, Camilly Gouvea; Bentes, Natália Mascarenhas Simões; vvvvvvvv; Neves, Rafaela Teixeira SenaLa paralysie du Conseil de Sécurité des Nations Unies (CSNU) par rapport à la Syrie a fait que certains pays adoptent des mesures plus incisives unilatéralement, sous le discours de la protection des droits de l'homme et du droit international humanitaire. Cependant, cette intervention en plus de mettre en échec la légitimité du CSNU, est légalement contestable. Cette monographe a le but d'analyser quelle sont les limites entre l'intervention humanitaire unilatéral et le crime d'agression. A partir de la conception contemporaine de la souveraineté et responsabilité de protéger, on passe à l'analyse des interventions humanitaires, avec emphase sur les unilatérales. Fait ces considérations, sera fait une étude sur la définition du crime d'agression, pour faire un comparatif entre le crime d'agression et les interventions humanitaires unilatérales. Finalement, sera fait une analyse sur l'intervention nord-américaine dans le conflit en Syrie, ayant par référence le bombardement qui a eu lieu le 6 avril 2017, ainsi que le bombardement du 13 avril 2018. Enfin, il est possible de conclure que les interventions militaires conduit unilatéralement, en plus d'être incompatible avec la Charte des Nations Unies, peut facilement configurer un crime d'agression, mais malgré les aspects matériels, il y a une grande difficulté à atteindre la responsabilité internationale pour le crime d'agression, en vertu des questions de procédure et d'une résistance politique.Item Territorialização étnica: sustentabilidade, desenvolvimento e a efetivação da cidadania plural dos quilombolas(Centro Universitário do Estado do Pará, 2014) Martins, Tiago Fernando Ramos de Oliveira; Moreira, Eliane Cristina Pinto; http://lattes.cnpq.br/7471628624621314; Fonseca, Luciana Costa da; http://lattes.cnpq.br/3383269305393137; Marin, Rosa Elizabeth Acevedo; http://lattes.cnpq.br/0087693866786684In 1988 with the promulgation of the Brazilian Federal Constitution, the “quilombolas” communities of Brazil were guaranteed the final titration of the territory which they traditionally occupy, from the provisions of Article 68 of the Temporary Constitutional Provisions Act (ADCT). The realization of this fundamental right of this traditional people has not happened over the past 26 years. The lack of knowledge about the “quilombolas” communities, as well as its folklorization rooted in society are factors that hinder the interpretation of the constitutional provision, however, what has prevented more definite titration maroon territories is increasing ineffectiveness of the National Institute of Colonization and Agrarian Reform (INCRA). In recent years its institutional paradigms have become a major obstacle to achieving the territorial rights of the “quilombolas” communities, such are normative statements that the administrative processing of titling one entranve to obtain outright is if the current Normative Instruction 57 INCRA. This instrument provides numerous internal regulations inconsistent with constitutional precepts directions, and also ignores the Convention 169 of the International Labour Organization (ILO), ie, it became clear that currently the INCRA seeks to satisfy interests that do not coincide with the Maroons of Brazil, running, in fact, a public policy titration maroon territories. The Gurupá “quilombola” community in “Cachoeira do Ararí” in the archipelago of “Marajó” in Para state, is an emblematic case in which several losses are incurred because of the ineffectiveness of INCRA to carry out titration.
