Item Judicialização das políticas públicas em matéria de educação pelo descumprimento das obrigações estatais(Centro Universitário do Estado do Pará, 2019-06-25) Bezerra, Cristielen Capareli; Brito Filho, José Claudio Monteiro de; Koury, Suzy Elizabeth CavalcanteCon la promulgación de la Carta Magna de 1988, vinieron varios derechos que son inherentes al hombre, entre ellos, en el presente trabajo, se prestará especial atención al de la educación, que vino con status de derecho público subjetivo, siendo dotado de exigibilidad ante judiciales. Se produce que muchas veces este, así como otros derechos enumerados en el texto constitucional, no son realmente efectivos, o efectivos como mucha deficiencia, por los poderes competentes, como el Ejecutivo y el Legislativo. De ese modo, a quién recurrir para tener esa garantía efectiva? Se trata como respuesta al Poder Judicial, que actúa para la efectivización de algunas políticas públicas educativas porque es lo que le corresponde hacer, visto que su actuación se da visando resguardar Directos Fundamentales, o sea, ante una violación flagrante a un derecho fundamental, sea individual o colectivo. El nombre que se da a este acontecimiento es judicialización de la política educativa, lo que acaba generando críticas al Poder Judicial en el sentido de que está extrapolando su esfera de poder, generando ofensa al principio de la separación de los Poderes, no obstante se resalta que transferencia de decisiones para el Judicial ocurre por inmensa necesidad de conferir efectividad a los derechos fundamentales socias justamente por ser el Poder que tiene la competencia de custodia de la constitución, lo que se desprende de todo el estudio es el hecho de que intervención judicial, en vez de ser un defectuoso, constituye una calidad esencial en las resoluciones de controversias para la atención de demandas que buscan tan sólo la efectividad de sus garantías. Para ello, se realizó una investigación bibliográfica, documental y teórica a través de un método deductivo, y como técnica, el análisis textual e interpretativo.Item O limite das obrigações do estado no fornecimento de medicamentos de alto custo a pacientes com neoplasia maligna(Centro Universitário do Estado do Pará, 2019-06-18) Rodrigues, Brendha Figueiredo; Brito Filho, José Claudio Monteiro de; Bastos, Elísio Augusto VellosoThe present study analyzes the limits of the State's obligations to guarantee the right to health in the distribution of high-cost medicines to patients receiving treatment for Malignant Neoplasia. Its purpose is to define the responsibility of the State in the distribution of remedies in a fair and egalitarian manner, taking into account the need of all those who seek, in some way, to guarantee their right to health and life. In order to do so, we indicate John Rawls's theory as sufficient to support this consideration, disregarding the Possible Reserve Theory, constantly applied in judicial cases to justify the inefficiency of the State, and to promote public policies guaranteeing the medicines necessary for individuals. We advocate providing medicines equitably to all citizens, especially those of high cost who are not registered with ANVISA and due to this factor, there is no provision by the Unified Health System. The methodology will be the bibliographical survey based on doctrines available in books and periodicals, articles and master's theses. Therefore, this is an eminently theoretical study, developed with a view to understanding that health is a fundamental right, especially in cases of patients with Malignant Neoplasia who require the distribution of high-cost drugs in a full and accessible way, taking into account in view of the complexity of the treatment and in most cases, patients' hyposufficiency.Item Os limites do aborto no ordenamento jurídico brasileiro(Centro Universitário do Estado do Pará, 2019-06-26) Medeiros, Elizabeth Parente e Silva de; Brito Filho, José Claudio Monteiro de; http://lattes.cnpq.br/7823839335142794; Souza, Luciana CorreaThe present monography that concludes the Bachelor's degree in law aims to give an overview on the matter of abortion in Brazil, it's modalities and evolution, offering some insight on its implications on the legal order. The goal is to demonstrate the necessary path towards the decriminalization of abortion as the only possible path possible, because it is necessary to the full realization of women's fundamental rights. In this sense, the discussion raised in this research is subsidized by a methodology of a basic nature, based on theoretical and bibliographic explorations that make possible the understanding of the theme and justify it's social, academic and professional relevance. The paper is structured in three chapter’s, in the first chapter we examine the main concepts of abortion and its legal treatment; in the second, We analyze the theses raised by Ronald Dworkin in his work the domain of life, as well as pass through liberal and conservative conceptions regarding the abortion theme; in the third chapter, an analysis is made of the jurisprudence of the country and of the Ação de Descumprimento Fundamental (ADPF) n° 442, which may culminate in the decriminalization of voluntary abortion until the 12th week, ending with a brief estimate of the judgment that has not yet occurred.Item Multiculturalismo e direitos humanos: o confronto entre a universalidade e o relativismo cultural(Centro Universitário do Estado do Pará, 2019-06-18) Mácola, Ana Luiza Crispino; Brito Filho, José Claudio Monteiro de; Vicente, Clarissa RibeiroWith the phenomenon of globalization and the accelerated development of means of transportation, technologies and communication, different regions of the world were brought together, enabling the approximation of people from different cultures, resulting in another phenomenon: the multiculturalism. Furthermore, it is a fact that all human beings are holders of basic rights, which could never be relativized or even violated, precisely because they are directed to each and every individual – they are the so-called Universal Human Rights. Thus, it is from the universality, main characteristic of the Human Rights, that the scope of these rights encompasses all human beings anywhere in the world. However, according to cultural relativism, a place where this universality does not exist, local knowledge has more validity than an international order regarding the rights of every individual. The main purpose of this work is to determine how to proceed before the conflict of interests between universality and cultural relativism, so that Universal Human Rights are respected and considered within each culture, having as basic support, the foundation of Human Rights, because both the existence of these Human Rights and the definition of the rights that will compose this set, are due to the dignity of the human person. Thereunto, a bibliographical, documentary and theoretical research was carried out through deductive method, and as technique, the textual and interpretative analysis.Item Refúgio internacional de pessoas transexuais: análise do caso Maria Clara de Sena(Centro Universitário do Estado do Pará, 2018-12-19) Fraiha, Bruna Sofia Potiguar; Brito Filho, José Claudio Monteiro de; Galende, Yasmin Dolores de ParijósThe persecution and hostility for sexual and/or gender issues is not a new phenomenon. Fearing offenses, tortures and even life itself, thousands of Lesbian, Gay, Bisexual, Transsexual and Intersex (LGBTI) people seek refuge institute as a means of protection. The present study analyzes the usage of international refuge by transexual people for discriminatory reasons. To do so, a conceptual analysis of transexuality is made as well as the distinction of gender, sexuality and identity and also the definition of transsexuality. It is also addressed the reality of vulnerability that transgender people face daily. In addition, it analyzes the institute of international refuge and the relation between international migrations and gender discrimination. Finally, a detailed study of Maria Clara de Sena case is conducted, which is a Brazilian transexual woman who had to seek refuge in another country because of persecution in her home country.
