In the scope of the methodological aspects, from a bibliographic and documental survey, the first section will analyze the advances in technology and conformity with the existing criminal risks within the internet. Then, the crime of larceny itself and its application through virtual means will be analyzed, in a first moment, briefly, relating it to the critical criminological knowledge, in order to provide a theoretical substrate for the discussion. Subsequently, in the third section, an examination will be made of the increase in the use of technological means by society in conjunction with the analysis of the increase in crimes of virtual larceny, and how criminal law has been absent in the application of sanctions for this offense. As well as, pointing out possible flaws and gaps in its construction along its formulation.
