Facing the proposed problem, analyzing the history of the union structure in Brazil to understand how collectives developed. In addition, it seeks to emphasize on which bases the collectives should be anchored in a crisis scenario, highlighting the political and economic functions. An analysis of Provisional Measure no. 936, current Law 14,040 of 2020, as opposed to the collective instruments. The number of collective instruments signed in Belém do Pará is analyzed. Subsequently, the main difficulties in the negotiating relationship and interdisciplinary solutions are addressed so that the parties are able to negotiate in both scenarios (of normality and of crisis). Finally, points out that, despite the various impasses that involve the business relationship, during the pandemic period, how they contributed to avoid dismissals.
